1. About these terms

Jaboticaba.in (“we”, “us”) runs the website at jaboticaba.in and the Jaboticaba.in app for iPhone and Android (together, “Jaboticaba.in”). By using Jaboticaba.in, or by signing in, you agree to these terms. If you do not agree, please do not use it.

2. Who can use Jaboticaba.in

You must be able to enter into a binding agreement under Indian law to create an account. If you are under 18, use Jaboticaba.in only with the involvement and consent of a parent or guardian, who accepts these terms on your behalf.

3. Your account

You can browse the species library and growing guides without an account. To use My Plants, save species or receive care reminders, you sign in with Google or Apple, which creates your account. You are responsible for activity on your account and for keeping the devices and the Google or Apple account you sign in with secure. Tell us promptly if you think someone else has used your account.

4. Your content

The plants, notes, photographs, care records and expenses you add (“your content”) remain yours. You give us permission to store, process and display your content to you, only to run and improve Jaboticaba.in. Your garden records are private to your account; we do not publish them.

Add only content you have the right to use, and nothing unlawful, harmful or offensive. We may remove content that breaks these terms.

Articles you submit for publishing. Articles are reviewed by our team before they are published, and we may edit them for clarity, length or accuracy, or decline them. When you submit an article, you confirm that it is your own work, that you have the right to share its photographs, and you give us a worldwide, non-exclusive, royalty-free, permanent licence to edit, publish, display and share it on Jaboticaba.in and our channels, credited to you. Once published, an article stays published: you cannot edit or remove it yourself, but you can ask us to correct it. If you delete your account, your published articles remain, credited to a former member.

5. Acceptable use

When using Jaboticaba.in, you must not:

• break the law, or encourage anyone else to;
• infringe anyone’s intellectual property, privacy or other rights;
• send spam, or use Jaboticaba.in to send unsolicited messages;
• try to access accounts, data or systems that are not yours, or test, probe or disrupt the security or operation of Jaboticaba.in;
• upload viruses or other harmful code, or place an unreasonable load on our systems;
• scrape, copy or collect content or data from Jaboticaba.in by automated means, except as search engines ordinarily do; or
• use Jaboticaba.in to build a competing product or database.

6. Our content

The species library, growing guides, articles, photographs, videos, design, logos and software of Jaboticaba.in (“our content”) belong to us or to the people who allowed us to use them, whom we thank on our Credits page. You may view our content and share links to it for personal, non-commercial use. Do not copy, republish, sell or otherwise reuse our content without our written permission.

7. Growing information

Our species information, guides and care reminders are general guidance, shared in good faith from our own experience and other sources. Plants, climates and conditions differ, and results are never guaranteed. Use your own judgement, and seek expert advice where it matters, for example before eating fruit you cannot identify with certainty or before using fertilisers or treatments. Care reminders are a convenience; we are not responsible for a plant’s health or for a reminder that arrives late or not at all.

8. Notifications and email

If you allow notifications, the app sends the care reminders you schedule and occasional announcements about Jaboticaba.in. Care reminders by email are sent only if you turn them on. You can turn notifications off in your phone’s settings, and change reminder settings in the app, at any time.

9. Features, plans and the shop

Jaboticaba.in is free to use. Some features may have limits on free accounts, and we may offer paid features in future; we will always tell you the price before you are charged anything. Jaboticaba.in does not currently sell plants or products through the website or the app. When our shop opens, separate terms for orders, payment, delivery, refunds and cancellations will apply and will be published before any sale.

10. Other services and links

Sign-in is provided by Google and Apple, and some features rely on other providers, listed in our Privacy Policy. Their own terms also apply when you use them. Links to other websites are provided for convenience; we are not responsible for their content or practices.

11. Deleting or suspending an account

You can delete your account at any time from your Profile on the website or in the app. Deletion is permanent and cannot be undone: your account and everything in it are removed, except articles already published, which remain as described in section 4. We keep a limited record of the deletion, as described in our Privacy Policy.

We may suspend or close an account that breaks these terms or puts Jaboticaba.in or other people at risk. Where it is reasonable, we will tell you first and explain why.

12. Disclaimers and liability

We work hard to keep Jaboticaba.in accurate, available and secure, but we provide it “as is” and “as available”, without promises that it will always be error-free, uninterrupted or suited to a particular purpose. We may change, suspend or stop any part of it.

To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of plants, crops, data, profits or opportunities, arising from your use of Jaboticaba.in. Nothing in these terms limits any liability, or any right you have as a consumer, that cannot be limited or excluded under Indian law.

You agree to be responsible for any claim against us that results from your breach of these terms or your misuse of Jaboticaba.in.

13. Governing law and disputes

These terms are governed by the laws of India. If a dispute arises, please contact us first; most concerns can be resolved quickly. Any dispute that we cannot resolve together will be settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, seated in Kerala, India, and conducted in English. Subject to that, the courts of Kerala have jurisdiction.

14. Changes to these terms

We may update these terms as Jaboticaba.in changes. We will show the new effective date at the top, and tell you in the app or by email before a significant change takes effect. If you continue to use Jaboticaba.in after that, the updated terms apply; if you do not agree, you can delete your account.

15. General

These terms and our Privacy Policy are the whole agreement between you and us about Jaboticaba.in. If any part of these terms is found unenforceable, the rest remains in effect. If we do not enforce a term straight away, we can still enforce it later. Headings are for convenience only.
